The engagement of M/s KPMG Assurance and Consulting Services LLP on nomination basis is proposed considering the highly specialised and time-sensitive nature of the assignment involving quantum analysis, cost-benefit analysis and risk mitigation strategy in relation to the Coal Gasification based Ammonia-Urea Project and ongoing commercial discussions with the Contractor. KPMG has prior experience with TFL, having earlier undertaken a detailed Cost-Benefit Analysis and evaluation of alternative project implementation models and submitted its final report in February 2021. Accordingly, KPMG possesses substantial knowledge of the project's history, contractual framework, financial structure, stakeholders and commercial considerations, thereby avoiding repetitive data collection and extensive familiarisation. Further, the assignment requires specialised expertise in contractual claims, project economics, risk allocation, dispute/settlement strategy and complex international EPC matters. KPMG has demonstrated relevant experience in claim assessment and expert-witness assignments for major infrastructure, oil & gas, steel, fertilizer and other projects. Considering the time-sensitive nature of the ongoing negotiations, significant financial exposure of TFL, and the need for expeditious and informed decision-making, nomination of KPMG would reduce execution and familiarisation risks and facilitate timely completion of the assignment. |
